paid and got taken to court anyway

Hi, yes I know this forum is to help people avoid paying. However, due to personal circumstances I didn't have the time and energy to go through this daunting process of defending VCS' claim.

I have received a letter before claim with a set day to pay. I put through a payment to execute at that day. Unfortunately it was Sunday and the money got sent and must have arrived on Monday, a day late. Now 2 weeks later I get a claim form from Vehicle Control Services, with a claim number and a headed paper from the County Court Business Centre, The County Court in Nottingham.

They are asking for less that I originally paid, like a few quid less. This is exactly what I aimed to avoid and now not only I have paid, but they are taking me to court anyway.

I will be frank and say that for me law matters are complicated and I avoid them if I can. How did I get here? I read a threat that said to ignore these people. Unfortunately, I had realised it was a threat from 2011 when it was too late. Ok, mistakes happen and it is my falt, no need to cry over it now.

Would you be please able to help me get out of this mess, is it worth contacting VCS to say I have paid? Maybe worth mentioning the money came out of a different persons account but the my case reference was there.

I should say that it was for stopping on double yellow lines for a couple of minutes to drop off my friend and doncaster airport. From my understanding stopping on yellow lines to drop someone off should be permissible?

    Has the money definitely left your account?

    Rather than call them, email the contact that will have been given on the LBC to state your case and that you are concerned that they have raised a court claim.

    They can withdraw, otherwise you will need to defend.

    I bet that Claim Form came from the County Court Business Centre in Northampton, not Nottingham. :D

    What is the Issue Date on your Claim Form?
  • It is Northampton, sorry for that. The date is 25th Feb 2018.
  • my friend's account, it has yes. it is dated 1 day past the due date.

    if the final day to pay was a non working/bank day , then payment should have been accepted

    no point in having a final day to pay on a weekend/bank holiday
