Emergency tax?

I started my job in August after having a year off work to have my son. They said as my P45 wasn’t from the current year they didn’t need it and I filled out a new employee type form.
The thing is I’m still on emergency tax! (Code TM01 I believe) I’ve rang HMRC several times, they have given me my new code and said that it’s up to my employer now and I should get my tax back in my wages. I’ve emailed, told them in person and given them a copy of my letter with my code but it’s still not being changed and I’m still being taxed. What can I do?

You are not on the emergency tax code.
The emergency tax code is exactly the same as the tax code most people are on (currently 1185L) it is just used in a special way so each pay day is looked at on its own without considering what happened earlier in the tax year.
If you were on the emergency tax code you would have to earn more than £988/month before any tax was deducted.
An emergency code moves to a normal "cumulative" basis when the new tax year starts (and would change from 1185L to 1250L this year).
But you aren't on the emergency code so your code number (probably 0T I think) will stay the same. It will be used on a cumulative basis but you will still pay 20/40/45% depending on how much you earn each pay day.
It is pointless giving your employer your copy of the code, they cannot use that. But why they are ignoring the codes sent by HMRC is a mystery.

I only earn around £70 a week so I don’t think I should get taxed at all? They said my code should be 1202L I think? I’m just confused as to why I’m getting taxed at all and why HMRC say my code is different to what it says on my wage slips. There isn’t anyone above my employer as they own the business.0

Can you remember what box you ticked on the new starter form. Can't remember exact wording but they are something like,
1). This is my first job this tax year
2). This is my main job now but I have had another one on this tax year
3). I have got other jobs or pensions0 -

Assuming that you remembered to sign it then your employer should have put you onto 1185L cumulative.
You might suggest to your employer that they use this site to check the code they are using.

If you try this site you may notice that the P45 they said that they did not need would have have acceptable and could have been used to put you onto an 1185L non-cumulative tax code.0
