    Hi All,

Just thought I would let you know that both claims have been struck out as an abuse of process.

“It is an abuse of process for the claimant to issue a knowingly inflated claim for an additional sum which it is not entitled to recover.”

    Thanks all for your help!

Please can you show us a redacted version of that Order, permanently hosted as a link in Dropbox or Imgur, so people can use it as an exhibit in defences?

  • Hello friends.

My apologies for not replying to the previous messages, I guess I had rudely jumped the gun and unsubscribed to the forum before receiving any notifications. However... I now seem to be in the same situation as CEC16. Before reading through the forum today, I initially thought it was about my case personally until I realised that the whole thing is much bigger than that.

I have spoken to the courts today and found out that there are many cases under the same umbrella booked in the calendar over the next few weeks. I have a hearing (under presumably the same conditions as CEC16) on the 5th December. Is there anything I need to do/consider before then?

Witness Statement (WS) is "in support of my defence as already filed" and should support, back up and expand upon your defence without repeating it wholesale or verbatim. Your WS is a narrative, your story of what happened on the day and subsequently and is written in the First Person.

You also need to supply any evidence that you refer to in your defence or WS.

WS examples are to be found in the NEWBIE sticky post # 2 as is all guidance.
