Bought a laptop from Argo and a query about their warranty and my rights.

About three weeks ago I bought a reconditioned laptop from Argos on eBay. It has since developed some dead / stuck pixels which makes it unfit for my purposes. The laptop was sold with a twelve month guarantee.


I have been in touch with Argos and they will not honour the guarantee insofar as they won't repair / replace the screen or offer me a replacement laptop. All that they have offered is a refund.


The reason I bought this laptop is that it was extraordinary good value considering how powerful it is and I would not be able to buy a laptop of at least equal specifications for the same price.


Does anyone know how I stand legally regarding this or, failing that, does anyone have any advice on how I should proceed to get my laptop repaired or replaced?


I'm clueless with stuff like this but as a long time lurker here I know there's a lot of very clever people who know far more than I do!

    They are putting you back in your original postition .
    Warranty what does its terms and conditions say especially regarding used equipment .Dead pixel policy as well worth looking at .


    Warranty/ guarantee is not your consumer rights .
    Legally it depends upon the warranty guarantees terms and conditions .

    Take the refund, you won't get anything better.

    Your laptop is faulty and it falls within the 30 day money back guarantee for faulty goods.
    You are getting what you signed up for..
    I think you may be liable for the return postage also....

    If it's Argos OP be able to hand it over the counter for return once arranged, should avoid any postage problems, unless of course nearest Argos is 50 miles away

    Maybe, Wasn't sure if they take returns from the ebay store of refurbished items.....Great if they do.

    How many pixels are dead? Contrary to belief dead pixels doesn't mean the panel is defective. There are a few different grades for panels under the relevant ISO standard and only the highest grade for use in things like medical devices and military devices have to be Class 0 which is defect free.

    Which of these pixel counts does your panel fit into?
    Class 0 panels are rare, defect-free screens that are often used within major government institutions and within the military.


    Class 1 panels are carried by the majority of major suppliers. Class 1 displays permit any, or all, of the following:

    1 full bright (“stuck on white”) pixel
    1 full dark (“stuck off”) pixel
    2 single or double bright or dark sub-pixels
    3 to 5 “stuck on” or “stuck off” sub-pixels (depending on the number of each)

    Class 2 panels (as used by Acer for example) - permit any or all of the following:

    2 full bright pixels
    2 full dark pixels
    5-10 single or double bright or dark sub-pixels (again, depending on the number of each; no more than 5 bright (“stuck on”) subpixels are permitted).

    Class 3 panels (found on some eBay shops) - permit any or all of the following:

    5 full bright pixels
    15 full dark pixels
    50 single or double sub-pixels stuck on or off

    If it is Class 1 or 2 you're likely to be unlucky in a warranty claim as it will be deemed to be within spec.

    It doesn't matter if it's a local store or distance selling, eBay in this case, you still have rights. The problem is that your rights are also governed, in some respect, by what is in the suppliers T's&C's. But as Tarambor has commented, dead pixels are allowed in the grading of the panel and manufacturers and suppliers alike normally cover themselves for such circumstances, more so with reconditioned items in mind.

    "The Consumer Rights Act 2015"

    "The Consumer Rights Act covers goods and services ordered at home (for example through mail order catalogue, direct selling or online) and digital content. All goods must be as described, fit for purpose and of satisfactory quality. If goods are found to be faulty, you must give a full refund up 30 days after the item was purchased. If goods prove faulty up to six months after purchase and they can't be repaired or replaced, consumers are also now entitled to received a full refund in most cases."

    "most cases" is the issue here.

    You could quote them the above act, in writing, and see what they have to say about it. You have nothing to loose.

    Long story short. I once had an issue with my car and the local Peugeot garage replaced my fuel tank, got the apprentice to do it, who made a bad job of it. It caused an MOT failure as 3 years later it sprung a leak. The GM of the company was really smug when I asked them to put it right, his words " Your having a laugh mate". The GM's attitude and stance got me riled and I decided not to let it go. Had I listened to all kinds of advice, none of it from this forum as I wasn't on here at the time, I would have paid for the repair and been done with it. Well the last laugh was on him when I quoted sale of goods and services act and the fact that it stipulated, in a deeply hidden clause, that any repairs carried out, under the UK act, were in fact covered for 5 years after those repairs were carried out. They had to pay up £2500 for another garage to do the job, I didn't trust them to do it again. It never cost me a penny, and the GM's efforts to let his garage carry out the repair needless to say fell on deaf ears.

    I didn't know about the 5 years in my case and I know a car isn't a laptop. But you have rights no matter what the product. So don't just give up, research your rights and be assertive when it comes to quoting and invoking them. If we can help we will.

    He's told them within the 30 days that it's faulty and they have offered him the refund. So they are within the act.

    But not what the full value of what paid for it. If the op applies more pressure on them they might just cave. It's always worth trying.
