Gift vouchers

Can someone please tell me what the law is around refunds on gift vouchers? I bought a tour using a gift card I had been given. The tickets were issued to me with incorrect details meaning I missed the tour. The gift card company have offered a replacement card to use on another tour. I don't want to book another tour with the company, I would just like a cash refund. Do I have any legal rights to demand this given that the goods they provided were effectively faulty?

    The vast majority of retailers stipulate that payment in vouchers will be refunded as such.

    I appreciate the mistake they made but they are returning you to your original position of having and amount on a gift card. You are not at a loss.

    By all means ask but expect them to refuse. Unless you can find something in their contract which says theyll refund a gift card to cash (unlikely) then youll be stuck with the gift card. You could always try selling it on a bit below face value. Or use the card as originally intended, all be it a different tour.
  • The company t&c says if it's on a gift voucher it will be refunded as a voucher if I decide to cancel, but nothing with regards to errors made on their part. Just wondered if this would be similar to receiving faulty goods?
  • Don't forget that as it stands, legally you have no right to a refund or replacement voucher.
    This is because the original voucher that you used was given to you by another person and it is that person (assuming they were the one who originally purchased it) who has the contract of sale so any rights rest with them.

    Even with faulty goods if you paid by gift voucher you are only entitled to a gift voucher refund and not a cash refund.
