Claim against dealer?
hi all
I bought a used car from a dealer around 5 weeks ago. Cost 3250.00
There was a 1 month warranty with it.
Within the 1st 3 weeks there were around 6 issues with it. I got 2 of them repaired at my own expense (220).
He told me the cambelt and water pump had been changed by the previous owner. Im now beginning to doubt this - Ive asked for proof but he can't get me it for some reason.
If i have this done myself it will be around another 300.
He has offered me 100 as a gesture but I'm really not happy - i could still be over 400 out of pocket.
Do i have any rights in this situation - i feel he should pay more - if not all of these extra costs?
Any advice would be really appreciated.
thanks
andy

You do not have any redress for the items you repaired as you would have needed to give him a chance to repair unless you were rejecting the car.
With cambelts unless you have seen an invoice for the job with the reg or vin number on assume it has not been done and negotiate on price to reflect the likely costs. The time to reverify this and negotiate the reduced price was before purchase.
Last car I purchased was private sale and he thought he had done the cambelt and water pump. It had extensive invoices but not for the cambelt so we made a deal on the basis that 50% of the cambelt cost at a dealer came off the asking price. Within a week it had a new belt and pump for what he knocked off the price done at a local garage.0 -
You want to maintain your car and you want the dealer to pay for it? Should he pay for you to change your brake pads or oil service in a few months?
As above, you've missed the opportunity to negotiate a better price on the cambelt issue. However you should be taking him to task on the 6 issues you have found, why have you paid for 2 of them? What are the issues you have found?0 -

I doubt even the most trained Jedi with the Midichlorian count equal to Master Yodi or Anakin would know if the cambelt and water pump was changed by the previous owner without removing the cover and inspecting it. Even if it wasn't changed and they SAID it was you wont have many legs to stand on, unless they stated in their advert that it was changed.
I would inspect it first before throwing figures at the dealer at this stage. I would also ask if the cambelt and water pump was changed but without an invoice proving it I would assume not, BEFORE I agreed to buy the car and make my offer accordingly.
Good luck with it.0 -
Ref. "There was a 1 month warranty with it."
I am always confused by this sort of thing as under SOGA, there have to be no major defects for at least 6 months doesn't there? So what is the use of a 1 month warranty?0 -

It's a useful trick to make uninformed buyers think that after 1 month there is no comeback on the dealer.0 -

Unless the buyer is a business SOGA doesn't apply, the relevant legislation has been the Consumer Rights Act since it came into force in 2015.0 -

SOGA doesn't exist, it's the CRA I think you mean.
It's complicated and if the dealer can prove the fault wasn't existing when the contract was made (the date of sale) then actually the dealer doesn't have to do anything.
The warranty is just "in addition" to our legal rights.0
