Ignored a ticket that was the drivers fault

I am new to this forum so apologise in advance if I do anything wrong.

Basic story is the driver received a parking ticket from 'Total parking solutions' in his work place car park. There are two different coloured bays, one for office staff and one for the trade staff.

The driver was later than usual one day so had to park in an office staff bay (driver is trade staff) and so came out at the end of the day to find a ticket on the windscreen.

The driver did the silly thing of listening to colleagues saying just ignore it (the driver now realises that this has been poor advice for several years).

The driver received the usual letters from the PPC asking to pay (to which he ignored) and has now received the debt collector letter from BW Legal saying the usual 16 days to pay rubbish and threatening court if the driver doesn't pay.

The driver has read the newbies thread and understands to either ignore it or reply robustly, however, because the driver was totally liable for the ticket then surely he can't get out of this if it went to court.

BW Legal have done the usual and added an extra £54 of legal costs on top of the PPC original £70. I understand that this extra £54 is a load of rubbish and that the court won't allow it.

Now because the driver realises he is at fault he is happy to pay the £70 before it goes to court however his question is how does he do so and not have to pay the extra £54?

    BW legal are trying to scam you, as are the PPC, complain to your MP.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..

    All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers. pt

    if the DRIVERhas not been divulged to the PPC, then any paperwork that has come in the post has come to the KEEPER, NOT THE DRIVER

    IF NECESSARY, the keeper can name the driver to the PPC, thereby the keeper is no longer liable under POFA

    I suspect your post #1 above is incorrect , as it mixes up KEEPER and DRIVER in the narrative, meaning it is confusing and needs editing until it reads correctly

    the PPC will not accept a lower offer now, nor the original pcn price , neitehr will B W LEGAL either
  • Please replace all 'Driver' with 'keeper'
  • It is not a case of a lower offer. I am willing to pay the £70 But not extra £54 which is illegal

    its not "illegal", you need to choose your words carefully , they can add a fee on if they wish to, whether they can actually get it paid is a different matter


    if it was "illegal", please tell us which law it broke ???


    and do not replace ALL WORDS with keeper, as some of it refers to what the DRIVER did on the day , so some of it is DRIVER and some of it is KEEPER

  • Suoersav, you need to use a laptop to get the full functionality of the site, including post edits. Suggest that you log on using a laptop.

    The reason you need to change the post is that the PPCs do lurk on here, so you don't want to give them anything to work with.

    Come off your phone and view the NEWBIES thread on a laptop or PC, and you will also then see the EDIT button under all your posts.

    You absolutely cannot fight this scam by logging in on a phone.

    He can't.

    Most cases are winnable in court, with our help, even when the driver made a mistake. TPS signs are rubbish, and maybe the coloured bays are faded, etc?
