Help Please what should I do next?

Hi everyone thank in advance for all your help. Let me fill you in on what I have done so far and the position I am. At the moment I am fighting parking eye over three invoices. Two of them are still with popla after being refused from parking eye. The other one I have received LBCCC after reading newbie thread I did the following sent there enforcement a email asking them to cancel the ticket and letting them no I have requested SAR they have replied saying I am guessing standard reply saying they acknowledge the receipt of the reply to LBCCC and said it was on hold for 30 days why they decided what to do.

I also sent a SAR to the department within parking eye I did it how it was mentioned in newbie thread I have had a reply not given all the information requested such as machine print out and no information regarding the case that related to the LBCCC only the other two that are with currently with popla strange but then I guess they don't want to give me details of the other before court i sent them a email back saying you have not provided all information about me as requested please do so or I will take it further. That was today so will be waiting for a response. Any help greatly appreciated.

Also just wanted to add I complained to BPA saying the picture show the car in complete darkness at 9:03 am and data relating to sun rise showing it could not be dark at this time the email is included in the information got under SAR so they must of forwarded my email to parking eye (can they pass on personal email between me and BPA to a third party that being parking eye without my permission?) the strange thing is the car is now in day light which I don't understand can they give a different image on this invoice to one they will provide in court?

read what the parking prankster website explains about ANPR cameras where he gave a detailed explanation and why such pictures are dark as all they need are the Number plate details (VRM)

if you have forbidden them to contact PE without your consent then no they cannot use your data or pass it on, no company can due to GDPR, so it all depands on what your complant said

PE have no right to not give you all the data on you under a SAR and can be reported to the ICO if they fail to comply this second time


the SAR request is a MUST, not an if or but in sight, but can only be about YOUR data, nothing else, so keep on at them for any missing data including redacted PDT data


you can insist on ALL pictures, now and at the WS + EXHIBITS stage, before court, and put them to providing them all for the court in your defence and WS and skeleton argument etc

Yes, IMHO. If you complain to a Trade Body about a member, you are surely reasonably expecting them to investigate the complaint with that member.

As you are still at LBCCC stage, is this a retail park and have you complained to the Store Manager - pre-court, it is not too late, be quick and they can cancel this one (usually easier if it didn't go through POPLA stage and cost PE money).

If not retail, which site is it, and have you complained to the landowner?

And your MP too, like this person did and got their P/Eye scam PCN cancelled?

We see landowner/retailer cancellations ALL THE TIME so make a real effort to try.

Thanks looked at the website seen alot of information with regards to anpr flaws thanks. I really think I must be the ANPR system that has caused me to get the three tickets as I always pay to park there and I have the ticket but on one of the invoices it saying I went in at 10:30 but the ticket I bought said I arrived just before 9am the ticket has my reg on as well so was surprised when they refused my appeal on that one.

On the the other invoice I had from them it showed the car in darkness and I no what your saying with regards to them only needing the registration I get that but on the first 2 tickets the car is in day light at the same time of day as the third one which the car is in darkness so do they have two cameras were one does it with day light and the other blocks day light out and just shows registration? If you have the link to the bit that explains about why some are in dark and others in light from the same camera that would be great thanks.

With regards to writing to the owner in my original appeal to PE I asked for them to supply me with the information of the land owner and authority to claim money on there behalf but they failed to supply that information.

It is a multi story car park with no barriers nothing to do with supermarket or shops .

We're do I go from here wait for court papers?

Have you complained to your MP?

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .
