Highview Parking - Borehamwood Retail Park

Hi all,
First of all thank you for a great site and all the valuable information.
I have read the newbies thread in full and a number of the other posts but have a couple of quick questions on an initial appeal to Highview Parking by the registered keeper (we were 10 minutes over the 3 hour limit) please:
(1) If the ticket came from automatic camera I assume we can delete the PDT paragraph. The quality of this camera is so poor!
(2) One of the passengers was 6.5 months pregnant - should I reference this in the initial appeal or wait for any POPLA appeal? If yes I assume you would say one of the occupants of the vehicle i.e. not confirming who the driver was?
(3) The property is a multi-let retail park. We have found details of the property owner (it is an American private equity provider) and the managing agent - when you email them should you refer to yourself as the registered keeper and refer to the person visiting as opposed to saying 'x visited' as this suggests you are the driver.
(4) Do you have any examples of emails to send to the property owners and managing agent at this stage. I have looked for a long time and couldn't really see any. The examples don't usually contain the drafts sent.

If you've read the Newbies thread you are on the right track. Send Highview the blue template from there. They usually cancel within a day or two of seeing the template.0

as above, do not alter the template , just use it as is, but avoid ticking or defaulting to DRIVER on their appeal page, make sure it says KEEPER or REGISTERED KEEPER or whatever (just not DRIVER)
do this first, no alterations, no contacting the owners as yet, wait and see if Highview cancel it quickly
meanwhile , download and read the BPA CoP on grace periods, clause #13 , because that applies anyway, never mind the EA2010
save your ammunition for now, go the easy route first, because if they cancel the rest is irrelevant0 -
No Highview threads are needed, they are so easy to push over, as long as you DON'T choose ''I was the driver and...'' in the menu choices (obviously).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

IMO, a three hour time limit in this facility is an unfair contractual term.

This shopping centre contains a cinema, leisure centre, Halfords, Debenhams, Boots, restaurants, hairdressers, banks, a post office, a casino, several other shops, etc., etc. etc.
If one were to spend only ten minutes in each, one would likely incur a PCN. This is not in the best interests of the leaseholders or the consumers, Complain to the Managing Agents, and your MP, and write bad stuff on Facebook/Twitter etc.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem become so widespread that MPs agreed to enact a Bill to regulate these scammers. Hopefully, this will become law by Easter .You never know how far you can go until you go too far.0 -
Just a quick note to say Highview sent an email confirming the PCN had been cancelled:
"Dear Sir/Madam,
Thank you for your correspondence relating to your Parking Charge Notice (PCN).
Further to your representations, we have investigated your claims and can confirm that your Notice has subsequently been cancelled in full and no further action will be taken.
Yours faithfully,
Highview Parking Ltd."

like I said previously, all the extra detail was irrelevant, because they cancelled at the first challenge, so no EA2010 issues were breached0 -
