  • Include a witness statement at popla stage, signed & dated by your girlfriend, stating the date and time of the breakdown and what she did to help, and the fact it took about half an hour to rescue you.

    my POPLA appeal was unsuccessful because apparently the signage is clear and therefore as I parked without intending to use the shops (as it was a Sunday morning and they were all closed) I am liable. So I guess I should pay.

    A PoPLA decision is not binding on the motorist.

    IMO the PoPLA decision is wrong. How can 300+ words of densely packed small print, some seven off the ground, and exposed to the elements constitute a contract? Is it reasonability?

    Pay them not a penny and if they feel lucky, let them take you to court where a judge can decide.

    in this case, where I think the decision is wrong and unfair what should I do if POPLA have refused my appeal?

    my MP is Andrea Leadsom but where I was parked, despite being 10 minutes from home has another MP.

    how much would going to court cost me if I lost?

    About £150.

    You guessed wrong as the others have said, and there is no risk on seeing what PE do and defending a claim.

    You have a defence, based on this frustration of contract, and a witness (your girlfriend):
    I parked on a Sunday morning at 8.15. I left at 10:00:16 according to my notice. I was late out of the car park because my key ran out of battery and I had to call my gf to come with the spare key.
