Radio does not work

Hi all
I bought a DAB+ radio with Bluetooth speaker for my wife in December 2017. In January 2018 I contacted the manufacturer from whom I'd purchased directly and was given a list of things to try which didn't work and resulted in a replacement being sent out in February 2018. Last month (January 2019) I contacted them again as the radio shows the same fault. It has done intermittently throughout the year but now had got to a point of requiring a daily factory reset and ultimately it no longer works. The company after confirming I had applied for their extended warrenty have offered a replacement but have no models in stock of my sort and so want me to pay £50 for an upgrade on a £39.99 product.
Am I past the point of being able to get my money back. I do not believe this unit was ever fit for purpose.

You may commission an independent technical report into the item and if that shows that the problem was most likely an inherent fault, you have a case, plus will get the cost of the inspection refunded.
After six months, the onus is on you to prove the fault was inherent.0 -
What Aylesbury Duck says is correct, but also keep in mind that even if the problem is deemed due to an inherent fault the choice of remedy usually lies with the retailer.
That remedy could either be a repair, replacement or refund.
However, as the thing has been 'repaired' once - the earlier replacement is considered a 'repair' in this context, as it makes the sold goods conform to contract again - you are entitled to insist on a refund.
Keep in mind that any refund after six months from the sale can be reduced to take account of the use you have had.
It appears that a replacement is not possible and the seller may not be interested in doing a repair anyway.0 -
It sounds like the seller has not been involved unless it was bought direct from the manufacturer.0

If it suits you try offering them £25, they may accept to get the issue done and dusted.
Just to add you may want to check the terms for the extended warranty and see what they say about resolving an issue when the model you have isn't in stock.In the game of chess you can never let your adversary see your pieces0 -
