End of tenancy query

Hello,

I have recently given notice to my landlord that i will be leaving the premises on the 16th March.

My rent is paid on the 27th of every month as opposed to the end of the month.

If i gave my notice on the 15th of Feb and my rent is paid a month in advance. Is it right to assume that i shouldn't be paying full rent tomorrow and then prorated up until the 16th of March? Thanks for any help!

Dan.

  • I think you have to serve notice from when your rent is paid

    Impossible to say!

    * England or Scotland?
    * tenancy or lodger/licence?
    * fixed term or periodic?
    * if fixed term, start/end dates
    * if periodic, period start /end dates?
    * if contractual periodic, notice period required (exact wording)?
    * date you served notice?
    * was notice that you would "be leaving the premises on the 16th March." or "ending the tenancy on the 16th March"?

    Now read:

    * Ending/renewing an AST: what happens when a fixed term ends? How can a LL or tenant end a tenancy? What is a periodic tenancy?

    3.Periodic (SPT)
    4. 27th - 27th
    5. Notice served 15th Feb
    6. Leaving the premises on the 16th (Landlord alsi agreed to end Tenancy on the 16th Mar)

    Thanks for your help.

    4. 27th - 27th impossible. I assume you mean 27th - 26th
    5. Notice served 15th Feb So notice expires 26th March
    6. Leaving the premises on the 16th (Landlord alsi agreed to end Tenancy on the 16th Mar)
    Well if you and the landlord have reached an agreement for an Early Surrender of the tenancy on 16th March, then the rent due is ... whatever you and he agreed as part of that Early Surrender.

    What did you agree? Is that agreement in writing?
