    yes it would dictate that, the agreement section is ASDA putting your item on the back of the van for it to be delivered. they are perfectly within their rights to refuse to sell you anything so long as they don't post it, they let you know and refund the postage.

    We must be thinking of different laws of contract

    The consideration is the acceptance and binds the contract, ie the accepting of the money. Asda can not [lawfully] refuse to sell something which they have already agreed to sell by accepting payment. (to be pedantic, there are some proviso's, but which don't seem to apply here)

    Of course, Asda's concept of binding the contract may well be posting the phone. But the lawful interpretation of this contract of sale is somewhat different.

    I'll just waiting for someone to chip in, along the lines of "...is it worth it the hassle for a £5 phone?".

    Here you go chum this was the link but when you click through now it is saying you have encountered a problem please call us.But if you work for Asda it does tell you the make/model of the phone in the address line(see above) so you may be able to order if you call with your staff id etc..;)

    Contract law would dictate that offer/acceptance/payment is a binding contract.

    If, in the case of a misprice, the price is so low as to be clearly wrong, then the store would have a defence.

    But in this case, this is not the situation, and the contract is binding

    Where did you get your law degree...just curious...or is this information readily available on the net...could be useful

    Just had an email telling me its staff only.

    Thats fair enough.

    I ordered before I knew this was the case. My money will be refunded so nothing lost.

    Thanks to the original poster anyway because I am sure they had the best of intentions.
