Hi, first posting so please bear with me. I ordered 3 of these phones yesterday, just recieved email saying that im not entitled to them, as their an employee offer only. Email stated i should of put staff id and store details in. This never came up at check-out. Am getting money refunded but annoyed0

I wondered why they weren't on the asda website...I don't think it should of been posted then..it was probably an asda employee or something who found/posted it...It would of been a good phone too for £50

I of often thort that bargin's posted here of bin too good to be true. But you of to admit that we would loose a lot of bargin's if people didn't post there things lol. Its been pulled. This offer was for ASDA employee's only and those not entering employee details (it did not come up but then the link given probably bypassed that employee page) had their orders cancelled.
I dont think you have a chance of getting it back, cos Im sure their T's and C's would of covered this.
Email from them reads
Dear Customer,
Thank you very much for your recent order for ASDA mobile. This is a colleague only offer and open only to colleagues currently employed by ASDA Stores Ltd.
We note from your order that it was placed by bypassing a welcome page explaining the terms and conditions of this offer and/or including the requirement to enter your personal valid ASDA employee ID number and store/depot place of employment. Without these the order can not be processed.
As a result of not entering all the correct details, the order you placed will be cancelled automatically over the next 24hrs and should any funds have been taken from your account, these will be refunded in full. No handset will be shipped to you.
If you are an ASDA colleague then we are very sorry about this inconvenience and ask that you re-order the handset via the advertised web address, having both your employee ID and place of work available to enter, both of which will be validated before the order is completed.

As far as I am concerned, I ordered via a valid [public] web link, linking to a publicly available offer - nowhere did I see any mention of this offer being restricted, not even in the T&C, and nowhere was there any forms to fill in any employee details. If Asda have taken payment, then it is worth pursuing. It's not a misprice and not a mistake, but a genuine sale/purchase or offer/acceptance, which should be honoured
If any T&C's were not veiwable, then they are not enforceable as they were not agreed. A large company such as Asda would be expected to make any conditions of the offer easily known - ie clearly visbile on the "click to purchase" screens0 -
yes, but as we had in several other threads, them taking payment does not consitute a binding contract. they've told you they aren't willing to sell you the phones and will be refunding your money. you don't have a leg to stand on.helpful tips

Contract law would dictate that offer/acceptance/payment is a binding contract.
If, in the case of a misprice, the price is so low as to be clearly wrong, then the store would have a defence.
But in this case, this is not the situation, and the contract is binding0
