UK CPM Data protection breach

Please help! I've read the newbie thread but I'm still struggling to understand the exact steps I need to take. Maybe I'm not bright enough. There's a lot of information to take in.
2 months ago the parking where I live (housing association) gave authority to UK CPM to regulate our car park. We have numbered bays/visitors bays. I was issued my permits which contain my road name and house number, which is my bay number also. I immediately requested UK CPM via email to take off the road name or house number which they refused to do. So I have been removing my permit when out and trying to remember to put it back in once home. I then received 2 parking tickets (we have 2 vehicles) on the same evening. As our permits were not displayed.
I feel this is unfair as i was in my allocated space, no one else can park there, the other vehicle was in a visitor's space, which we are allowed to park in.
We emailed the housing association to revoke these pcn's which they said they would do, but have since written us a letter stating as our permits were not displayed we have to take it up with CPM.
I've left very angry as they are in breach of the data protection act. I've raised a complaint with the information commissioner's office regarding this. But they can't help with the tickets. But if they had changed these when we originally asked we wouldn't be in this situation.
So now I am ignoring these PCN's although 1 vehicle is a lease work van too, so it's getting complicated.
Is this too much for me to handle, should I just suck it up and pay their unfair charges? The stress is hard for me to handle and it's only the beginning. Feeling way out of my depth

number one question, with regarsd to residential space issues:
What does your lease/rental agreement say about parking, you said that you have a numbered bay?
what was the situation with regards to permits / parking when you moved in?
Whoever employed the parking company will be jointly and severally liable for its actions ( ie the management company )From the Plain Language Commission:

Opt out of the 'permit' scheme and demand the managing agent cancels the PCNs.
You do not have to accept a permit scheme - you already have an existing right to park and it can't be re-written on more onerous terms by foisting an unsolicited and expensive charging scheme on you.
Please read as many residential UKCPM defence threads as you can and I mean at least TWENTY.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

They did a poll 4 months ago because 1 household decided to keep 6 cars in the carpark. We apparently do not have an option to opt out as it is now already in place and we originally opted in (4 months ago), after the housing association said we would not have these issues (over the phone) and that it was purely to stop this other house keeping so many cars. So I naively agreed.
We've lived here 6 years without any issues. Our lease agreement states we have 1 allocated space which is numbered with our front door number. It obviously mentions nothing about this private firm as they were not in place back then.
I will keep reading threads but not all applies to our situation. I also do not understand all the legal talk, but I am trying.0 -
Of course you can opt out if the Housing Association lied. Write and complain, and keep complaining until the PCNs are cancelled.

I am going to be calling them everyday as this is just so unacceptable.
We are definitely regretting it. But not everyone opted in, the original letter stated it would go with a majority vote. However we believe the housing association were going to put it in no matter what because of the problems they were having from this other house.0 -
Of course you can opt out if the Housing Association lied.
I suspect that HAs are not governed by the same rules as private landlords CM.
However, that does not stop the OP from complaining to the Housing Department,
their MP, and, if the HA is a registered charity, HM Charity Commissioners.You never know how far you can go until you go too far.0 -
PERMIT ? what permit ?? Your right to park was established well before these vermin were allowed in
Why did the HA decide on UKCPM ??? UKCPM are the worst residential scammers.
The HA did not do their homework about UKCPM and as a result the residents are now being subjected to harassment

You need to get a residents meeting going to vote these vermin out. The directors of the HA must be made aware that if any court cases arise, they will be called as a witness to explain their actions to a judge.
No doubt the HA has signed a restrictive contract. Are UKCPM using any electricity that the residents pay for in a service charge

I completely agree 100% they did not do their homework. They also were unaware of the authority they were handing over to these scammers.
The HA are now back peddling and after 3 complaint letters from me and my husband and several phone calls they have just had the 2 PCN's revoked, small victory.
However the HA apparently had to 'beg' for them to do it! That's absolutely disgusting and I'm getting a sense that the HA are regretting their choice because of the hassle they're getting.
I'm thinking about putting 2 boards together:
1 for signatures of those who are happy
2 to opt out of the UK CPM having charge
I'm sure over half will now chose to opt out because of these problems it's caused.
The HA are also looking at the breach of data and contacting their solicitors regarding this. So I'm yet to hear back on that.0 -
Well done on getting the PCNs cancelled. Definitely keep onto the other residents especially if they have received PCNs as well.
Make them aware of this site, and point out that their lease/AST has primacy of contract and it overrides anything a third party unregulated scammer can say or do.
Please also complain to your MP about this unregulated scam. Point them in the direction of Sir Gregg Knight's private parking bill, and use the words in red you will find from post 1 of the NEWBIES.
Keep hammering the HA/MA, and tell them in writing you hold them responsible and[ they will be required to attend court for any and all PCNs if UKPCM take that route.I married my cousin. Very pleased to hear this. Do warn all other residents.
You are all at constant risk of a charge and then being sued, as are all your driver visitors. Forever, until you force the HA to kick UKCPM out.
UKCPM offer NO APPEAL worth trying, at all. It is futile. The HA should be ashamed.
