I understand what you are saying but the EA the surveyour and the viewers were ALL told about the land throughout, including the particulars of sale on rightmove etc.
This is a legal issue, but you don't mention the solicitors, the Council or lender above.
The solicitor's job is to check the legal title of the property that their client is proposing to buy. The legal title didn't match the sales particulars and they queried it. They would also have to report the discrepancy to the lender. No matter how many buyers you have, this will keep coming up every time.
Your buyers might be able to sign a Waiver Letter from their solicitors, which will say that the buyers accept the land and boundary as is and have decided to proceed without accepting advice from their solicitor. Otherwise, move the fence back or risk losing your buyer and future buyers.0 -
This is the issue the solicitors and council have both been told. The land registry and the particulars do match. The only thing is a fence been put up but we will fix it. My point is we brought it as it is and it wasnt an issue for any legal entity then it was straight forward for us just wondering why its any different now.0
