    I am at court on Friday in regards to this PNC.

    IN a nutshell, I paid the parking, the machine give a ticket without the need to input the VRN, subsequently I received a PNC in the post for failure to purchase a valid ticket.

    Do anyone have anything that I could help say to help my case when I attend court on friday. I have the ticket I purchased and have submitted this into evidence.

    It will be a case of the machine allowed to purchase a ticket without a VRN input, the machine has no backlight on the terminal so it was near impossible to see or read any text, that i didn't agree to the charges so paid the alloted parking time. They have come to no material lose, as the allotted time was paid for, only on a loss now with chasing and taking this to court.

    Any guidance will be greatly appreciated.

    Does this mean you have filed a Witness Statement with the Court? - just wondering if so, why a draft was not posted for comment by the forum as the Defence was.
  • Yes I had to submit a witness statement it was about 5 paragraphs long with the ticket submitted as an exhibit.

    Sorry, I assumed at that stage it be a bor to anyone to comment.

    Thinking back now I should have posted it.

    Yes you've missed loads, and need to read CEC16's thread and print out and take with you the CRA 2015 schedule 2 printed out x 3, with paras 6, 10, 14 AND 18 (in your case) highlighted.

    Read CEC16's thread then get up to speed with the fact you can throw in the CRA even though it wasn't in your defence or WS. Print out para 71 as well, to show the Judge that the court has a DUTY to consider the test of unfairness in every case, and there are 4 paragraphs breached.

    Cases are being struck out without hearings in a few courts due to PPCs adding sixty quid and you really, really should have covered this 'abuse of prcess' in your WS.

    You also sound like you didn't even mention the signs being inadequate, in your WS?! It is fundamental to the claim to attack the small print signs, as they form the contract.

    Luckily, the CRA 2015 lets you do this at a hearing, without mentioning it in your WS!

    Not only that, we now advise filing & serving your COSTS SCHEDULE at WS stage. Did you, or don't you want to claim your costs when you win? If you do, search the forum for COSTS SCHEDULE and get it emailed 24 hrs before, to the court and the Claimant's solicitor.

    But first, read CEC16's thread which was about... Britannia Parking!
