PPI claim rejected by Lloyd’s, advice?

I recently put in a claim to Lloyd’s for missold PPI on a credit card I had back in 2001. I received a letter back from them stating they had rejected my claim due to a letter being sent out to me back in 2015.

At the time I was living away from my home address at the time and my ex partner would have returned all of my mail to sender. Basically my address was not update date and I didn’t receive the letter.

Is it worth my fighting their decision?

Anyone had a similar situation and been successful?

    They may overturn the timebar if you can show that you moved, but unlikely to just because you were living somewhere else.
    No harm in trying though, you can either write back to them and explain you didn't receive the letter, or go to the FOS with the same reason. Probably quicker to try them first.

    Did you still hold any facilities with Lloyds when they sent the letter?

    Ultimately your case is time barred if you can provide good evidence that you weren’t living there.

    You'd need to prove you were living elsewhere (such as being on the electoral register or having other bills going to the new address). If you can't, they'll just assume you are trying it on as normally if you move address you pay for mail forwarding and/or update all the firms needed with your new address (or even say a parent's house if no permanent residence).

    There was a recent FOS decision where the address had not been changed and it went in favour of the bank because the T&C required the person to keep the address up-to-date.

    So, based on that, you would expect the FOS not to overrule the time bar if this was an account open at the time. it it was a closed account, you would expect them to overrule it.

    To cut a long story short I didn’t update my address as I had no where to update it to. I was living between addresses after splitting up with my partner.

    The credit card account I was sold PPI on was closed years ago but I still held a current account with them.

    I will tell them my situation and see what they come back with.

    Then unfortunately time bar will still stand as the onus was on you to provide an address.

    Apologies as I know this is not the information you were hoping for but don’t expect Lloyds to overturn as this has been the default position on this complaints for a while now.

    Unfortunately in this case then the complaint will likely be time barred properly - the bank don't know you weren't receiving mail and you should have updated them to stop mail going out (it could have been sent to your parents or even a PO box or similar). Allowing your mail to keep going to an address you weren't living at was always a risk of missing vital information.
