Check if your HOME insurance covers your business .
You dont normally travel to the court see MSE Small Claims guide.

Thanks, I'll look into that as I didn't know that.

As a sole trader, I work as an online retailer. I'll look into S75 with the credit card company and see if that's another option.

Is this something to nip in the bud straight away or is it something I can look into in a month's time? I only ask as I'm going away on Tuesday for 4 weeks holiday.

Thanks again for all the replies - much appreciated.

OK as an online retailer you have business insurance ??
Its almost certain that home insurance would not cover .

Can you claim it as a loss on your income tax returns or VAT ??

I'm hopeful of another route. Although a lot of money, I'm unsure I can take the time to pursue that and I suffer quite badly with stress so I know it would impact my health so I don't think I have it in my to go to the small claims.

No doubt they'd involve an expensive lawyer to fight their case. Also, I don't have much in the way of evidence, other than original invoice, UPS courier postage label and invoice and a screenshot showing proof of delivery. Guess the lawyer could say I sent an empty box back to them.
With the evidence you have, plus your telephone bill and a print out of your previous Amazon record, the small claims court should be entirely straightforward.
You use your most convenient court, but the English system is much better than the Scottish one. I would be inclined to visit your local court to get someone to explain the how the system works and particularly how your claim is delivered. (I remember that I was originally told that you had to use a lawyer, but it eventually transpired that recorded delivery was good enough.)
If this is inconvenient use the online system.

If this wasn't an agent in UK, but overseas it might be worth trying one more time on online chat around 8am in the morning, which might give you a better chance of getting an agent actually based in Dunfermline. Maybe.

Thanks for the follow-up replies - gives me a little hope. :)

One other thing I also thought about was sending the CEO of Amazon UK an email. Ok, it'll likely be an assistant who will look into it but perhaps they might investigate what's actually happened with the information I'll provide in the email, including invoices and screenshot of delivery. Always worth a punt, right?

It worked for me with a different company (Qatar Airways) when they messed up - didn't get anywhere with call centres and such but by sending the CEO an email it nipped the whole thing in the bud and we not only received our money back but were given credit towards a new trip.

Otherwise I'll look into the small claims once I return from my trip if that falls on deaf ears.
