Hi all
Im really hoping i can get some support here. Last July i parked in a private car park and paid £2 for 2 hours of which i did not overstay my duration. i then received a letter stating 'insufficient time paid' and pictures where i entered and left the site within the 2 hours so it did not make sense.
i then found my ticket and to my surprise my reg was not on it properly as in the first 4 digits were but then they were repeated again as in 1234 1234. I then recalled having to enter it about 3 times because the machine kept spitting out my money and i had my sick 7 month old baby in my arms so when it finally printed i didn't pay attention and stuck it in the car.
Anyway the letter received was from smart parking and i have appealed to popla 3 times all declined, its now with DRPL and they are having none of it as i refuse to pay as i didn't overstay my course and there is no other car in the country with the misprinted reg so why would it be deemed as accpetable.
I called DRP yday as they called and left me a message and they said i can still pay £170 and if i don't i will go to court. They also advised these cases don't normally win so i will get a ccj which im fretting about!

Never ever call a DCA. If this goes to court you will be in a far better position if you can show a judge a paper trail. Besides, they will lie to you, a DCA cannot instigate court proceedings.
The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..
All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.You never know how far you can go until you go too far.0 -

The courts are aware of the whole scam and Smart are not so smart

If this went to court, you can prove you paid, what did Smart do with that money ???? Smart would lose, you claim costs against them, up to £95 ..... something to look forward to.
Not long ago, Smart fired some of their directors for fraud against the company ..... they even scam each other0 -
Yes we all know what you mean about the stress, its not on but keeps happening unfortunately.
As you have already been advised your in IGNORE mode now, certainly don't engage with DRP SCUM!!
You might want to keep reading around the Forum learning more about LBA/LBCCC which you may or may not receive in the future and then you will have a head start on how to deal with this.
