Distance selling P&P refund

I recently returned a pair of boots I purchased online. The retailer has refunded the cost of the goods, but has refused to refund the delivery charge, which I thought the Consumer Contracts Regulations stated they need to refund.

Their response was "Unless we you have notified us in writing of your wish to cancel the order rather than return it, we do not process the P&P refund"

Is there a difference between cancelling the order and asking to return the goods? I sent my request in writing requesting to return the goods

Technically they might be, but if you did write to them asking to return them before sending them off then this would probably be seen as correct, so should get your outward postage back.


If you just sent them with a returns label then you didn't cancel properly.

If you read the relevant legislation it uses the term "howsoever expressed" (or something like that) in relation to cancellation. A seller's T&Cs cannot contract out your statutory rights - if their returns T&Cs state that you must include a returns label then that would still be covered by "howsoever expressed".

They really should not.


Others do automatically refund if the whole order was sent back (you sent back a whole order right?)
