Formal letters/emails need a clear statement at the end, as above.
Thank you for your response to my SAR. I note that you say "In regards to your request for the PDT machine record, this will not be provided as under GDPR, vehicle registrations are deemed personal data.". In response I must point out that I am entitled to a copy of the PDT machine record for that day showing the data that relates to my vehicle, which you acknowledge exists in a previous letter, and information that does not relate to my vehicle can clearly be redacted as necessary in order to comply with GDPR.
Please send the PDT machine record, redacted as necessary, by ...... at the latest (the date to be inserted will be the deadline for the original SAR request).

When they refuse to supply the information (and they will because it is more work for them), raise an ICO complaint. I did that and spoke to a chap from the ICO who said that HX weren't on their radar. The more that raise concerns to ICO then the more aggravation these parking chancers will get.
Remember, they simply want you to shut up and pay, they have no interest in supplying any information that may help your case. Please read the stickies, your question and situation will have been covered before. Let's keep the board clear for the most experienced members to help genuine new and interesting situations. :j0 -
Update: The second response from the Data Protection Officer included the following included the following:
In regards to your request for the PDT machine record, again, this will not be provided due to data protection. You failed to enter your full and valid vehicle registration relating to your vehicle therefore there is no record of this on the machine data-we cannot provide data that does not exist".
Their response to the original appeal included the following:
"You entered the registration "**" (just two letter, hidden for privacy here). As this is not a full, correct registration for your vehicle............".
Clearly therefore HX do have information related to the vehicle.
Should the RK make a complaint to the Information Commissioner, about the refusal to release the PDT machine record, redacted as necessary for data protection, showing this information which they clearly state is related to the vehicle concerned?
If so, what is the best way to go about it?
Thanks again.0 -
Post #25 above refers to this issue and the need to pass this on to the Ico0

Ok, form found on ICO website, complaint being sent now, making it clear that they have information on the vehicle that they are refusing to send.0

Latest Updates:
Firstly, County Court Claim received, Issue Date 7th May. My understanding is that this means that the service date is 12th May. An acknowledgement of service was filed through moneyclaim online on 14th May. I think this means that a defence has to be submitted by 9th June. Can someone who knows please confirm this is correct. Assuming this is correct it is hoped to put a provisional defence for comment on this thread early next week after a full reading of the stickies.
Secondly, the complaint to the Information Commissioner has not achieved very much. The complaint was forwarded by the IC to the DPO at the parking company, who then sent the same reply as previously. Any advice on what to do now please? (especially from Coupon Mad please) It is really important to do this as I am sure that the PDM data will confirm that a ticket was paid for, will show what was entered, and may even show that the machine was faulty. The company has already admitted in the appeal response (see earlier posts in this thread) that a ticket was purchased but "the full registration was not entered".
Thanks again for all your help.0 -

Some useful bits on my thread about them for when you do your witness statement and need evidence. I had the same issue and they lost against us in court on Monday.0 -
Do you still have the ticket from the machine? I'm sure their machines are set up to rip you off and not work properly.0
