He informed her , so gave notice, that the fence was being built, she agreed so they aren't trespassing.
She's not complaining about the fence being built just that it's more intrusive than she thinks it was going to be.
Thanks for pointing out what I said was incorrect, except it wasn't.

That's a bit like the landlord telling me that they're going to repaint a wall at some point in the future, and me saying OK... then them letting themselves in without consent one day and gutting an entire room though, isn't it? I agreed to a fence being put up on our neighbours property - not to them levelling our garden.

If you agree, you're giving them consent aren't you?
Course, i could be getting that wrong too.

You were, you are backtracking now (and you are still incorrect)
  • To them putting up a fence on their property, around our boundary... not to them digging up all of our planters and levelling our garden...

You can agree to X, and not to Y.

Fence being put up, the OP wouldn't be able to refuse consent.

Anyone is entitled to put up a fence on their land.

Having her garden dug up; im guessing she didn't agree to that...

Thanks for pointing that out and there was no backtracking....notice/agreement is mentioned in the first post, ownership of the planters is still in doubt.

Good job it's not my garden then isn't it? Because if I had a landlord who said the fence was going to replaced [and it is his job to maintain the fence, and who wouldnt agree to someone else doing it for him?], I agreed to it, and then I got upset about it because they didn't magially remain outside my garden to do it, and I didn't actually ask what was involved in it, I might have a problem
    Luckily I don't.

There is no need for a jcb on the OP land to put up a fence.

Do you not think it's a bit strong that they said they were going to put up a fence and have in fact levelled my garden?!!

Did you check with your LL what was agreed? He might be really cross that he only agreed to a fence going up but his tenants didn't stop a digger levelling his garden. Surely if you're old enough to have a baby you're old enough to have a word with workmen digging up all your planters and levelling your garden?
