House insurance refused after accident

I would expect your house insurance will claim their loss back via the vehicle Insurance so I'm surprised premiums are so high. May be its because the case is pending until work is done then your insurers may reclaim their costs.
If the claim is still ongoing, then the cost won't have been subrogated from the TP insurer. OP's home insurer will currently have a bill for £42k until the reinstatement is complete.0 -
The renewal will be inflated due to the risk associated with the claim and also the costs involved. in all honesty its irrelevant whos fault it was as home insurance doesnt work on a fault/non fault basis in the same vein that vehicle insurance does. from my experience making a complaint probably wont get you anywhere as if the underwriters feel that your too high risk and want to charge that premium, then they certainly can.
personally i think the main issue is that the work is ongoing. therefore when an insurer asks if your home is in a good state of repair (which is a common question) you cant really answer that it is. which will increase premiums and even discourage insurers to even quote. try a broker, that will get you a LOT further0 -

Exactly, that's why it's always best to claim on the at fault party's insurance so that the cost is all on them. Live and learn.
Good basis for a complaint though. The fact that it hasn't been resolved and the other party has not paid up is because your insurer is not processing it quickly enough. Maybe they are waiting for a final total but in the mean time it's screwing you unfairly.0 -

That's certainly true however claiming through your own insurance does give you added protection of using the insurance ombudsmen if there is a problem where as I don't believe it can be used when dealing with a third party as you are not their client.0
