Have taken this down as was hoping for some expert advice, not abuse.

    If your dad hadn't died how would you manage ?

    Its not yours until she dies. She's not dead.

    You got £25k when he died, and you already had the house. the fact you have spent beyond your means on your house refurb is no ones issue but your own.

    It was clearly your father's wish that his wife/ your stepmother should have the security of remaining in her home, so why would you look to find ways to both disrespect his memory and force her to leave her home?

    Look at your entitlement to benefits as they are available to the self employed and sick. Rather than expecting your stepmother to sell up to release money for you why not sell your property, clear your debts and move into rented accommodation you can afford.

    Your financial problems are not your stepmother's responsibility..

    Where would your stepmother live if the house was sold?

    Surely, since she has a life interest in the house, if it was sold she would still have a life interest in the money which would be invested and she would be entitled to the income from the investment until she died.

    Who is the trustee as that is the person who deals with the trust administration and would be responsible for selling it not your stepmother.

    Is the situation of forcing the sale of the house not if the trustee does not sell it after the death of the person with the life interest?
  • Shame no one copied what the OP asked. Someone was asking about this kind of thing the other day, not in a bad way I mean if their children could force a sale of a house after a husband died

    This is expert advice - pay a solicitor if you want - she/he will tell you the same thing.

    A) doesn’t understand something very simple
    B) is going to give away their expertise on legal matters free on MSE forums once qualified.

    The OP was left a sizeable sum by her dad, who also left her the house with a LIFE INTEREST to the step mother.

    Now the OP has run out of money and is repeatedly asking her elderly mother to sell her home to fund her lifestyle.

    OP will probably report this in an attempt to get it deleted AGAIN as she is clearly embarrassed about her actions, as she should be.
