Deposit paid but failed MOT

Hope someone can advise me. I went to view and test drive a car at the weekend. Everything seemed fine with it and the dealer said they would service and MOT it. I have just looked today on the check-mot.service.gov.uk website and discovered that the car has failed the MOT for the following reasons:

Nearside Rear Suspension arm pin or bush excessively worn (5.3.4 (a) (i))
Offside Rear Suspension arm pin or bush excessively worn (5.3.4 (a) (i))
Nearside Front Brake pipe excessively corroded front to rear (1.1.11 (c))
Offside Rear Brake pipe excessively corroded front to rear (1.1.11 (c))

Bit worried the car's going to cause me even more problems as it had these issues. Am I within my rights to ask for the deposit back? I didn't sign anything and paid it over the phone as I was worried I'd lose out on the car.

Where do I stand here?

Is the dealer going to fix the issues? If they are then they won't cause you a problem.

Yes, the agreement was the it would pass the mot and they would service the car. I don't really know much about cars, but I'm worried that there might be more issues in the months to come given that these issues have appeared.

Am I able to get the deposit back? I didn't sign anything, the deposit was paid on the assumption that the car was in good condition.

It's a second hand car. If you want guaranteed issue free buy new.

The dealer, so far, has done nothing wrong. It's gone for a test and now he knows what to sort out before handing over a perfectly good car.

If it won't pass an MOT you can have your deposit back. If it does you can enjoy your car that has been repaired, inspected and found to be good.

At least you know the dealer doesn't have a mate willing to issue dodgy MOTs.

Any second hand car can have issues, when it's fixed and tested you should have a roadworthy car. If you really don't want it now you'll have to have a chat with the dealer. You could go buy a different one . . . with different problems.

What make, model, age and mileage is the car?

If you're buying a secondhand car, you're only going to buy a car that has had no fails in the past? That is preposterous.

Surely it's better to buy a car that's had the fails fixed rather than have advisories?

They are just normal issues that happen with any second-hand car. Pay the rest of the money and keep it maintained.

What they said. Some sellers would have just got a 'pass'.

Its had issues. It failed the mot. The dealer will put these right. Thats over and done with and not cost you a penny. Surely thats better than having these problems when you have to mot it?

I would check that the work was carried out by visually looking at the probable areas. Will it cause you problems in the months to come? Maybe, but any car will get these problems at some point.

As for getting your deposit back, you can only ask. But if I was the dealer I would not give it back to you if I sorted out the issues and got a pass as agreed when I took your deposit.

I thought the deposit was paid on it passing the MOT and service was carried out - which it would of when you collected it.
