Hit by an un-insured driver..

Hi All
I was at the traffic lights when a car ploughed into the back of mine last week.
Luckily nothing serious just a lot of whiplash, badly damaged bumper and 2 days sick.
I have fully comp insurance with Tesco and they advised to take the car to X repair centre and that I would get a hire car which both happened.
However a 2 days later I had a call from the hire car co to say I was hit by an uninsured driver and they took the car back.
To add to my probs I went to pick up my repaired car and they made me pay the £250 excess as I was -yes you guessed it - hit by an unisured driver. Tesco say they cant do anything about it.
I havent reported it to the police yet but will do this week but surely Im the innocent party here but Im being made to suffer and pay!
I really cannot beleive the hassle I have been through cos of this jerk not to mention the bad back and neck I suffered.
Any suggested/avenues welcomed!

Are you mad? You've have been injured in a road traffic accident by a non insured driver! Get it reported now - BTW you may get a HORT 1 producer so make sure you have all your paperwork in order.
I was hit by an uninsured driver, but had a courtesy car. MIB is a waste of time for the damage to your car as you are fully comp, but they may help wih your injury claim.0 -

You are right - I did try to report it - went to the local police station and they said someone would see me - 1 hr later still waiting so I gave .
Will get it done asap though

As daveyjp correctly mentioned, the MIB will not be of any use as far as the property damage is concerned - as they will only deal if there is no comprehensive insurance inforce that covers the loss. There is a £300 excess on property claims under the MIB uninsured driving agreement anyway.
No excess applies to MIB injury claims though.0 -
The excess is the amount you have agreed to pay towards each and every claim. So yes, you do have to pay it, even if the accident wasn't your fault. If the other driver had been insured and Tesco received an admission of liability from their insurer then they are likely to have waived the excess but are under no obligation to do so.
With regard to the hire car I take it you didn't pay the extra for the guaranteed replacement vehicle? If not then the car was being supplied on a credit hire basis, and the cost would have been claimed back from the other driver's insurer. As there is no insurer then the hire company have no guarantee of getting their money back and sensibly ended the hire.
The joys of uninsured drivers....0
