My father bought a mobile phone stupidly with cash 3 years ago from ID M0bile/Carphone Warehouse in Gloucester.
On seeing a better deal he returned to the shop and cancelled his contract,Gave the phone back and got his money back to the sales person.
His wife 'my mother' died last week and he needed to change all the bank accounts over and also apply for a credit card.
The bank told him there was a court order against his name.
Turns out that the sales person says the phone was never returned and wants my father to pay for it.
The following has also happened.
The dept has been passed on to two dept collectors
Both have said they are not interested because it sounds too dodgy.

Sorry, but as written this doesn't make any sense. How could someone buy a phone with cash, take it back and get a cash refund, but then be accused of not giving the phone back?
I don't see many shop workers being stupid enough to refund cash for something they didn't actually get back?0 -

Sure, but the original story doesn't make any sense. The OP doesn't seem to understand what actually happened, and Resolver can't resolve an issue where the complainant can't explain the problem accurately.
If I had to guess, I'd say that the father took out a phone contract which included a phone as part of the bundle. He then went back and cancelled the contract but didn't give back the phone (or the shop worker ~says~ that he didn't give back the phone).
If he got no receipt for the phone, I'm not sure what you could do, three years later. It would seem to be a simple case of his word against that of the shop worker. In this situation, maybe ID/CW would be prepared to write it off, though it probably depends on the value of the phone that has gone missing.0
