Reread fhe OP. It isn’t a fleet policy. The driver arranged cover. The driver was oblgated to disclose all material facts when making the claim. I am suprised you think that they only need to disclose it if specifically asked. You are obligated to FULLY answer all questions. The suggestion that they needn’t record that they were drunk whilst criminally driving is absurd. Itis the same obigation as when completing the proposal form.

Your link is pre Consumer Insurance Act.

Hope she gets the sack and the "alpha" gets taken off her. She don't deserve it.

    Hi All,

My sister was involved in a drink driving accident in October 2018, she has just received a letter for her court date, 27th February.

She was 2.5times the limit (203mg of alcohol to 100ml of blood)..
It gets more complicated, its a company car but she has to insure it. The insurance has already paid out for the write off and her work have already given her another car (Alpha Romeo 17 plate).. She also wrote off the car she hit and their insurance has paid out.
Her insurance are currently unaware shes facing a drink drive prosecution..
Could someone advise what punishment she will be facing in court and if her insurance/company will chase her for the repairs/write off costs to both cars?

    Thank you
Did she lie to the insurance company in the first place? If so then she may have a lot more to worry about than the cost of the two cars and any I jury claims, there could be a fraud conviction coming her way and I’d assume loss of job could well be on the cards too.

    [QUOTE

Drink driving does normally invalidate your insurance cover so the insurance company will be within their right to reclaim their outlay. I'm surprised they don't know that intoxication was involved... was this not covered in the questions they asked her when claiming? I hope she didn't 'miss that part' out

Not normally the case, unless the policy specifically excludes cover.

Fleet policies tend not to have such an exclusion as standard[/QUOTE]

Indeed I thought ( may be mistaken ! ) that it is only the Admiral group of companies that invalidate cover
I never Drink and Drive but the idea that my offspring could have their drinks spiked or what ever and then I lose my insurance fills me with horror
Hence I am glad I can afford not to go with cheap and nasty insurance companies

. Also expect disqualification for at least 18 months for over 200mg I'm afraid.

I'm not "afraid". Deserved disqualification has a more appropriate ring to it

  • I suspect we will never know, the OP logged off straight after their final post and hasn't been back since.

Maybe we will get an update, I find newbies don't tend to come back with an update.
