The registered keeper is liable for payment of the unpaid Parking Charge Notice if they are unable to provide us with the driver’s details at the time the Parking Charge Notice was issued.
Please refer to Protections of Freedoms Act 2012 Schedule four for further details on this.
If you are able to provide us with the drivers details at the time the Parking Charge Notice was issued we will contact them directly.
If you cannot provide us with these details, we will have no option but to pursue the claim against you as the registered keeper.

who is the PPC ?0 -
Which parking company? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks for the quick reply guys. I dont know if this is important but there was no ticket on the car it was sent through the post Addressed to 'The Keeper' via their work scheem lease company. so the PCN came in their name. The managment company have confirmed they forwarded the details and are now not involved any more.
Not to question your advice (which i am gratefull for) but do i know just not reply again until they send the cancellation or POPLA code? Or do i need to request this information from them.0 -
if you appealed it as keeper, then wait for a popla code, as they have no idea who was driving and you dont want them to know. let them fail to follow various procedures because you will win this on a technicality, so the more they fail, the better your chances
LEASE vehicles are a bit different so read the bottom of post #1 of the NEWBIES thread again, especially read anything by member edna basher
a popla appeal will be as a hirer/lessee and will also focus on the PPC failing POFA due to not forwarding a copy of the hire agreement to you with their NTK that arrived by post (this is a common failure so I assume you didnt receive any hire docs)
read post #3 as well of that thread for popla advice, but base any popla appeal on anything on here that is similar and about hire or lease or company vehicles
so not the private owner popla appeals0 -
If you have had an NTK in your own name then all is fine. If you appealed by email watch for a rejection email going to your junk folder. It happens all to often.0

They replied to the appeal already thats the reply in the first post but no mention of the POPLA code. im going to look at the lease stuff now and see what it says.
cheers again0 -
If you don't get a code in about a week or so complain to the BPA that you have had a rejection but no code.0
