Now we received answer from Lowell. It looks like they don't have documents.
They replied: We have requested the required documentation from the original client Oakam ltd. with regards to your request for a copy of the deed of Assignment, please be aware that we are not obliged to provide this document to you. Due to the nature of our business, accounts are purchased in bulk and as such this document would contain sensitive information relating to other customers accountsDeleted_User wrote: »BS as they could blank those details out and only send the part relating to you.
You are not entitled to see a copy of the deed of asignment for reasons stated above, you are however, entitled to see a copy of the notice of assignement.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Then they are asking for the wrong thing, a deed of assignment is a document containing names, addresses, details of debts etc for however many debts the company has just bought.
These companies buy portfolio of debt in bulk, this document could contain many thousands of names.
Its the notice of assignment that relates specifically to the debtor, and that they are entitled to see.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. my question is why they trying to get money back from us if they don't have any papers?0 -

Yes, thats standard practice, as these debts change hands without ever having to produce the original agreement.
Expect to wait a few weeks for them to find it, thats if they can find it.
Its important to know what you can and cant request from these people, you are doing ok.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. When we called Oakam before and asked for all documentation they said that they don't have it anymore. Everything was sent to Lowell.
Now I understand that Lowell doesn't have it either.
Lowell should send me my original credit agreement within 12 working days. Am I right??0 -

Usually all original documents are kept by the original creditor, on sale of the debt to Lowell, they may of also disposed of the paperwork, thinking it was no longer needed.
Guidelines state 12 days, i was going to say expect it to take longer, as they have to go back to the OC for it, but not in this case it seems.
If neither of them can produce a compliant credit agreement, then the debt will be unenforcable, see what Lowell come back to you with first.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
