When I put my offer in for my house, one of the terms of my offer was that they immediately take the property off the open market upon receipt of my reservation payment.
They replied stating they agree to all of my terms including taking if off the market (written).. Once I paid my reservation fee they sent through the paperwork with the above included.
Legally, I don't know if they can re-market it once you've paid your reservation fee, you need to read your own individual correspondence with them for a definitive answer mate!0 -
I don't disagree that there is something in the agreement saying they won't market the property while you've reserved it but I'm also sure there's something in there that states if you give them reason to believe you won't meet the deadline then they can remarket
From the OPs post the brokers lack of communication has given them grounds to believe exchange won't happen in time. hence why I'm saying get all of the facts and plead your case.0 -
