Debt defaulted but when sold default removed/not added

Options
Back in 2015 an account I had with the Co-Operative was defaulted. I received the notice.

The account was then sold to Link Financial.

On my credit file there is an entry by the Co-Op showing a default date of 02/01/2015

There is also a duplicate entry owned by Link Financial (same account number as the Co-Op one) and it doesn’t have a default applied to it.

Does this sound correct? I thought a debt could only show once on a credit file, and if a debt is sold with a default, the buyer must apply the same default details as the seller?

Thanks for any help

  • The debt can be shown twice if a DCA has purchased the debt.

The original debt must be closed/satisfied with a zero balance and the new entry from the DCA must show the balance and the same default date from the original debt.

Thank you for your help. The original account (Co-Op) does have a balance of 0 and marked as settled.

Is there a legal template that you may know of I can use to ask Link to look at the account and add the backdated default? The only one I found was to have a date changed on an existing default.

    Thanks.
  • You don't need a template.

Just ask them to do so.

Just an update to this. I emailed Link and sent screenshots saying that they should have applied the default when they took over the debt. Today I received a letter from them saying they agree and they have decided to remove their entry from my credit file.

Now I just need to get the co-op to back date the default to at least 2013 as that was when I was 6 payments in arrears.
