Uni tuition fees termination of employment

Ok, we are clear, no matter if my employer is fair or not, am i underpaid or not, I have to repay training cost as per conditions in the agreement signed by me.
That is clear. Thank you.
What about duties I have that are not in description?
When I started new duties were not required and I didn't do them.
This is not just more advanced tasks of the same job. These are actully different duties, like payroll and IT, and my position has not even remotely anything to do with those tasks.
Can I just stop doing them?0 -

No you have agreed to the change in contract by accepting these new duties.0 -
Why agree to start a degree if you were not happy with your salary?0

If you did you would probably find yourself out the door pretty quick, with a poor reference (or at least not one that is positive) and still having to pay the course fees.We made it! All three boys have graduated, it's been hard work but it shows there is a possibility of a chance of normal (ish) life after a diagnosis (or two) of ASD. It's not been the easiest route but I am so glad I ignored everything and everyone and did my own therapies with them.
Eldests' EDS diagnosis 4.5.10, mine 13.1.11 eekk - now having fun and games as a wheelchair user.0 -
my argument would be it is unfair dismissal, as I still am capable and willing to do my duties - and because of that don't have to pay back tuition fees, or have to be reappointed on position. It would be a pressure on employer to either improve my salary, because of the duties he wants me to do, or to dismiss me waiving the tuition fees
It was never written or agreed I should to other tasks, I just started to do them as I was the best person to do them, have the best abilities to do it.
The case is clear i am underapaid and they know it, they just blackmail me with the tuition fees0 -
my argument would be it is unfair dismissal - it wouldn't be unfair dismissal (and you haven't been employed 2 years anyway) , as I still am capable and willing to do my duties - and because of that don't have to pay back tuition fees, or have to be reappointed on position. Please stop, you're making yourself look very silly0 -

You need to grow up a bit and start adulting.
If you mentioned unfair dismissal you would be laugh out of a court room. You simply do not know what you are talking about (ignorant).
You can claim unfair all you want but youve agreed to every single unfair practice. Simply by doing the duties you agreed to doing them. You stop doing them, theyll almost certainly sack you.
What youre saying is unfair, everyone else is saying is part and parcel of employment contracts. Something which you agreed to. So you agreed to the unfairness but the problem is you did actually think it was fair enough at the time. Otherwise you object.
If you believe you are underpaid and think you can earn more, there is nothing stopping you doing it. Presumably theyll want their training costs back which you should be able to pay with your pay rise. THat is of course on the assumption that they will be happy accepting a payment plan. Otherwise youll just need to find the money before you leave.
I remember my college tutor telling me that for every extra responsibility my employer gives me i should be asking for a pay rise. I tried it a few times, they told me to shut up or go home. Yup i successfully passed in to adulthood.0 -

Unfair dismissal would be THEM sacking you. Often that is related to a "protected characteristic" too, like being disabled or discrimination or pregnancy etc. Or, at a push, them not following their internal dismissal procedures (I believe you usually need 2+ years of service for that).
The phrase you want here is "constructive dismissal". Ending up in a position whereby your position is untenable through the employer's fault and you have to resign because of it. A lot of the time it is again linked to "protected characteristics", but it is possible that it could happen in other circumstances like yours. But I will caution you that it isn't easy to argue "constructive dismissal", more so in your case which is very unclear (to say the least). It was never written or agreed I should to other tasks, I just started to do them as I was the best person to do them, have the best abilities to do it.
Check your contract as it usually says something like "other tasks from time to time" which is a fairly strong (but not iron-clad) get-out clause for them.
If there isn't anything in your contract to that effect then you may have scope to push back on the new tasks (if you are diplomatic with the employer).
Aside from that, I've been in the odd job where my ability has been > than the requirement and, whilst I have been taken advantage of, I've made sure that I got something out of it. You never know if those "other tasks" will serve you well in getting a new job in the future. The case is clear i am underapaid and they know it, they just blackmail me with the tuition fees
As advised previously, I feel that this issue should have been addressed BEFORE signing up for the course.0 -
you just need to find an employer that will give you the 25% payrise, pay for your ongoing training, and give you a £10k "golden hello" that you need to repay your current employer.
Are you that good at your job that the unique skills you have will be in such demand that another employer will pay that to get you on board?
Alternatively, you just take the 25% payrise and pay your previous employer back. If you are on £25k currently you will get a pay rise of £6k, so you will have plenty of spare cash to pay your previous employer back.0 -
Hello,
My employer pays for my UNI course, it is a degree. Annual cost is 4.7k, I'm on second year, so the cost up to today is 9.2k
And as others have said, you needed to ask these questions before you agreed, not over a year afterwards.
You can treat this as a very important lesson as you make your way towards adulthood; if you sign a deal you then need to honour it. You have to raise your questions at the right time, and changing your mind afterwards is no reason for the petulance you are displaying here.0
