Next Of Kin

Quick query. My uncle sadly passed away last week. He was never married nor had children. There is no will, no instructions etc. My query he was the youngest of 3 children the other 2 are still alive, who is classed as the next of kin? He always gave my other uncles name for hospital records as he lived closer.

    Are you asking who the hospital should have contacted, who can apply for letters of administration or who stands to inherit if he has any assets?

    Next of kin is only a term used by hospital. Someone, a close relative, will need to apply for letters of administration to deal with the estate. The two siblings will inherit in equal shares. The the deceased sibling have any children? If so they will shre a quarter between them.

    The deceased sibling is the uncle ;)

    Also I believe the siblings only inherit if their parents have predeceased the deceased sibling. Except in scotland where they'd inherit jointly with the parents. IIRC anyway.

  • Thank you all for taking time to respond. Nothing to inherit money wise. We believe he doesn’t even have enough for his own funeral but the two remaining siblings have agreed to pay half each for a simple funeral. Reason for asking was that the two remaining siblings can’t agree on where the funeral will take place Church of England or Baptist Church so wondered if either was in Next of Kin position to make a final decision. I’m guessing because of state of affairs that they have equal say ......

    Next of kin has no legal meaning in terms of decision making when people are alive, let alone when they have died.
    What church did your uncle attend as that would be the obvious choice, and if neither then why have a church service at all?

    Unless the deceased person has a connection to a particular place of worship then it is quite common for a neutral venue like the crematorium to be used.

    Can more of the family act as mediators to help resolve any conflict.
