UKPC Ltd – Success – on Appeal

Thanks to the help and information in the forums I’ve successfully had my PCN cancelled on appeal. See the timeline of events below.
Received windscreen PCN on 3/12/18
Read Newbies thread. Waited approx. 26 days. Submitted appeal.
Received the UKPC template reply asking for driver details on 28/1/19.
Replied on 0n 01/02/19 advising them no NTK received within 56 day timeframe, cancel charge or give me POPLA code.
11/02/19 - Not received a decision to my appeal and no POPLA code provided. Now on day 45 since appeal was submitted and there’s been no decision. I contacted the BPA and raised a complaint.
12/02/19 - UKPC replied to appeal on Day 46 with following:

Thank you for your recent correspondence in relation to the above parking charge. We appreciate the
inconvenience this has caused you. It is not our intention to cause undue worry and frustration when enforcing our clients' parking regulations.
We have investigated the appeal based on the information you have submitted and confirm that in this instance the parking charge has been cancelled.
We strive to deliver a high quality service that enhances the existing quality standards insisted upon by our client and ensure our wardens are stringently trained to meet these expected standards.
On behalf of ourselves and our client we apologise for any inconvenience.

UK Parking Control Limited


Don’t give into these unscrupulous parking companies. Follow the advice on here and follow the system. It works!

    Well done, and thanks for letting us know.

    What they really meant to say was, we messed up by failing to send a NTK and got caught out, so decided not to waste 27 quid plus vat by losing at PoPA.

    Please now complain to your MP about this unregulated scam.

    The3y have wasted your timr, noe waste theirs, complain to your MP.

    The whole industry is a scam, relying on threats of court, and the public's ignorance of the Law, A bill is currently before parliament which will regulate the scammers, many of whom are ex-clampers.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Second Reading in the Lords this month, and, with a fair wind, will l become Law later this year..

    All five readings are available to watch on the internet, (some 7-8 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    AFAICS, they did not breach the COP, they tried to scam you for money that, in law, they had no entitlement to. Some people would call that attempted fraud.

  • My understanding is that the BPA Approved Operator Scheme - Code of Practice -Section 22.8 specifies 35 days for an appeal decision to be made. It wasn’t until 46 days that I was finally informed of the decision. I will bring this to the attention of the BPA, DVLA and MP and let them make enquiries to decide whether this is a breach of the code, but I feel it is.

    It's almost certainly why they dropped their case against you.

  • Yes, that and Notice to Keeper time frame expired.

    I might as well tie them up and give them increased work load and paper work replying to BPA, DVLA and MP responses.
