Have you hit a brick wall when complaining about this specifically?

Pretty much.

I guess our next step will be to go above POPLA's heads and complain to the directors of Ombudsman Services Limited themselves to bring their attention to the fact that the service being provided by their POPLA underlings is not as professional, independent and impartial as they have promised.
• Hi Sketch

It's okay for you to enter to name of your company as the "appellant" - i.e. first name, ABC, surname Limited. However, I recommend that the main body of your "appeal" is written on company letterhead and signed by a named individual with an accompanying statement duly authorised to act for and on behalf of ABC Limited.

The letter should then be scanned as a PDF and uploaded on the portal. You can paste a short message into the text box on POPLA's portal to include the main bullet points of your "appeal", stating that your full submission is contained in the attached letter.

If the person named in the letter is not an officer of ABC Limited (as registered with Companies House), you will need to upload a PDF copy of a second letter signed by an officer of the company confirming that the person submitting the "appeal" has the necessary authority to act on behalf of the company. When you upload this second letter, select "Third Party Authority" from the drop-down list of document types.

For future reference, should you have the pleasure of dealing with POPLA again, they require a letter of authority to be provided for each and every POPLA case. This is quite ridiculous when you consider that you don't have to be an officer (registered with Companies House) to represent your company in the Small Claims Court. The guidance that the "Sector Expert" has been dishing out to his team of POPLA assessors makes him look very silly indeed.

Hi Edna Basher,
Thank you for this information - it was very helpful in getting the details correct before finally submitting our 'appeal'.

Also we would like to again thank Coupon-mad for your help above.

We have now submitted the full appeal document and the separate third party authorisation letter and will now await a response.

It has now been just over 3 weeks since we submitted our appeal to POPLA. During this time we have been waiting for Euro Car Parks to respond to our appeal but we had heard nothing until the following e-mail arrived today......
Dear ABC Ltd

Thank you for submitting your parking charge Appeal to POPLA.

An Appeal has been opened with the reference xxxxxxxxxx.

Euro Car Parks have told us they do not wish to contest the Appeal. This means that your Appeal is successful and you do not need to pay the parking charge.

Yours sincerely

POPLA Team
Massive thank you to Edna Basher and Coupon-mad for your help with our appeal. Another success story to add to the list!

Excellent - well done Sketch.

ECP knew all along that they hadn't complied with POFA yet still they saw fit to put you through the rigmarole of the POPLA process.

One change I'd like to see come in through the new Private Parking Code of Practice Act is a requirement for an "appellant" to be suitably compensated by the private parking company for their time and effort spent in successfully challenging an incorrectly-issued parking charge. I suggest that a sum of £100 (or £60 if the parking company pays up within 14 days of the independent "appeal" assessment) would be fair and reasonable.

Brilliant outcome, well done for sticking with our advice and winning!

I agree with Edna Basher, the public should be compensated for waste of time POPLA appeals.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Perhaps you could/should pass that thought on to your MP - for consideration by whoever is charged with producing the new Code of Practice.
