Non-fault accident

Hi, Im trying to find out if i can claim for "damages". Last year someone crashed into my car, they took full responsibility and the car was taken away and fixed. I was happy as i thought that was the end off that untill i got my insurance renewal which has gone up by 30% because i was in a non fault accident. So im now going to pay more for several years because off this i have always had a clean license and never been in an accident before this. Can i claim damages against the driver as it has and will continue to couse me financial strain. I have tried to speak to solicitors but they only deal with injuries which i wasnt. If someone can please help me it would be much appreciated.

    Shop around. You will probably find other insurers that won't increase it by as much.

    No, you cannot claim damages against the other driver. You are deemed to be a higher risk because you were involved in an accident, even though it was deemed the fault of the other driver.

    Technically you can claim future premium increases from the 3rd party at fault. (It's a loss caused by the other party's negligence). Whether anyone has actually done that though, or how, I've no idea.

    After my at fault accident my insurance premiums went down. Do i need to give the person i crashed in to some of my savings?

    There is some evidence to show that if someone is involved in an RTA then even if it's not their fault they are statistically more at risk of having another accident/claim. 30% is ridiculous though, definitely shop around.

    It's not caused by the TP's negligence.


    The insurer's decision is based upon their estimate of the OP's propensity to be involved in accidents. That propensity has not changed: all the TP has done is to bring it to the insurer's attention.

    I tried this a couple of years ago - its not a head of claim, not even an uninsured loss so you wont get anywhere.

    What was last year's premium and NCD?
  • Last year premium was £450 and it went up to £600 and couldn't get anything cheaper (15 years NCD and no points on license) Thanks for all the input
