Reclaiming Excess a

Hi
Last April I was involved in an accident where It was nearly a hit and run but the driver did stop and quickly exchanged details and then drove off quickly afterwards.
My car was a write off, my insurance paid a settlement quickly minus the excess whilst they fort for liability and there money.
I rang up in September to see if the other driver had been in touch and the third party had admitted full liability and the case was closed as my insurer had got it's money back. I then asked for my excess back and was told that because I had legal expenses i would use there solicitor for reclaim. I sent all paperwork in.
Last week I rang then up to see what was happening and was told the other insurer had admitted liability but weren't sending me my excess. I asked why and thy couldn't give me an answer and kept saying we are continually trying to pursue them and there not answering.
How come if they in the first case admitted liability is it alot of trouble just to reclaim my excess.

how much was the excess, who was the insurance company?
write/email a letter of complaint to their customer service company saying you expect an immediate acknowledgement and a reply within the time frame of 8 weeks.
if not resolved through their response letter use the FSA

Thank-you earlsgate. Third party insurance company is Zurich Commercial, and mine Axa.
Would that jeopardize any dealings I have with my legal cover and the company who is meant to be sorting it.

might be worth copying your letter of complaint to your own insurer and the legal cover and await all three parties written response whilst you sleep easy as the FSA will then resolve anything not to your satisfaction when they have had chance to reply and resolve the situation.
these formal complaints in writing always seem to get the ball rolling as it shows you are not to be messed with and it costs them big time if the FSA are needed should you are not satisfied with their responses0 -
Your own insurer has not duty to you regards your excess as you made the decision to bear that cost yourself. It's therefore an uninsured loss and you have to try and recover it yourself. Your legal expenses insurer should be recovering it for you. Instruct them to issue proceedings for recover of said excess if they aren't getting any joy from the other side.0
