HMRC debt has been moved to DCA despite me paying the agreed payment plan

Last year we received a overpayment letter from HMRC to which we dealt with straight away and set up a monthly payment plan.

This was agreed and we received a letter detailing the agreement. I've been paying this for the past 5 months without delay and the money has always been there.

Last week we received a letter stating our debt has been forwarded to LCS debt collectors due to not paying the debt and the letter states we need to pay in full or set up a payment plan.

Why would this happen when I've been making the agreed regular payments? Any help?

First of all check that the monthly payment has been sent each month (DD showing on your bank statement?) Could have been a glitch with your DD or something similar.

Once you have evidence of your monthly payment then telephone with your payment plan letter and find out what has gone wrong.

If you have evidence that you have been paying it and the letter agreeing to the payment plan then offer to send HMRC this evidence to prove that you have kept to your agreement.

May just be a simple mistake on your part, their part, or the bank's part.
  • Thanks for the advice - I have the proof of dd payments leaving my account to HMRC.

I'll give them a call tomorrow!

Was wondering if it's a way of getting people to pay faster?

    Don't call anyone especial DCA.

Just keep the DD running, as you are keeping to the agreement paying HMRC nothing else can be done.

Hello; I'm afraid that HMRC accuracy has reached historic lows in numerous areas. I doubt it's you, really. Lately I've had letters accusing me of late filing and payment of VAT when both had been done early. They used to be very good but all the old hands left or were forced out. Accountancy Age ran a front page feature last year covering just this. Let us know what they say. Humdinger1

In addition to pmlinyloo's advice -
Write to the debt collectors to tell them you are disputing the debt and ask them to put the matter on hold. Enclose a copy of your correspondence to HMRC.

If HMRC are slow to resolve this, then ask your MP to intervene.

You are right not to ignore the letters.

Don't contact DCA at all they are powerless to do anything against you and don't pay anything to DCA.

Just keep the DD going to HMRC and checking your bank account that payments have gone to HMRC.

My advice would be to contact HMRC, point out that you have been paying in accordance with your agreement and ask them to recall the debt from DCA. If they agree to this you may wish to write to HMRC confirmed the conversation (and could send a copy to DCA).
Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.

When you set up the DD did you :
    1) Make sure you quoted the right reference number
    2) Quote the right HMRC sort code and account number to make payment to
    3) Check your bank account to make the payments were going out
