But that's not what the OP is asking ... they're not looking to cancel, they're looking for a refund due to the contract not being completed (i.e. no successful delivery).

Whilst non-delivery would normally lead to a right to cancel, I really don't know the answer in this scenario though.

This is it exactly - the goods were never delivered, not received - not cancelled

Imho this would appear to boil down to what is reasonable? Was a reasonable attempt at delivery made?

It sounds as though the florist has done everything in their power to effect delivery. The flowers were shipped and when it was evident delivery hadn't been effected attempts to contact the recipient were made to no avail.

I would say the friend is most at fault here.

I am (very) annoyed with my friend

Did you friend know to expect a delivery? I get "very annoyed" with people who send me gifts I am not expecting as I've no idea what's arrived, just that "something has" .... and I don't even look in my exterior postbox most days - and the gate's locked, preventing access to the front door.

If I know I am expecting something then I'd unlock the gate and be alert/looking for things over 2-3 days.

More than that ... what if your friend had never received something - and you had simply "hated them in silence as they never said thank you".... if you don't know something's coming, you don't know it's not arrived.
  • yes they knew, I told them I would be sending, tracking was sent to their email address and to their phone with ways to change delivery to a different day, place or pickup from postoffice
    they just didn't respond
