Santander default and going to FOS

I’m looking for some advice please.

I started on a DMP three years ago.

Three of my debts are with Santander... loan, credit card and overdraft.

The credit card and overdraft defaulted in 2016 and we’re passed onto debt collection.

The loan never defaulted and stayed with Santander.

In may last year I contacted Santander as I was intending on putting payment arrangements in place directly with my creditors. The monthly offer towards the loan was more than what they had been receipt through my DMP.

I was told Santander if I did this directly with they would then default my account which didn’t make sense.

I asked why they hadn’t already defaulted when the account fell into three months of arrears. I logged a complaint and I have it in writing dated June last year there was a system error and they should’ve defaulted the account in March 2016.

As I’d rather have the default backdated as it means my credit rating quicker, I again have this in writing it would be done in July 2018.

In November I checked my credit file and this still shows late payment so I logged another complaint. Again it was blamed on a system error and I was told this would be rectified.

Now in feb and no change to my credit file.

On the first complaint they compensated me £150 and the second £200 which I accept was a welcome gesture.

However I have now logged another complaint as this still hasn’t been sorted and the late payment markers are going to remain on my credit file longer than a default.

I’ve registered a dsar today for file notes about the complaints and advised I intend to make this further.

Whilst I’m not the type of person to try and get out of paying my debts, and I’ve already been compensated, I would like Santander to write off the debt as the run around trying to sort this out is driving me mad and they have not stood by their outcome.

What would everyone suggest please? Am I being greedy?

  • They won’t write the debt off no due to admin/clerical mistakes.

    Get the DSAR and if necessary write a complaint to the FOS for the default backdate.
