  • It's still not really clear what happened but the key thing here is if you opened your door and then he drove into it, or if his car was already in the way when you opened the door. I suppose the third option is if you opened the door only a moment before his car drove into it.

    The sequence of events matters here. It determines if she should have seen the door or if you opened it in a way that make it difficult or impossible to avoid the collision.

    Oh, one other factor. You say he was waiting for you to finish parking. Obviously when someone has parked they will open the door and get out. If he didn't anticipate that it might increase his liability.

    Unfortunately on modern cars it does often cost a lot to replace headlight glass and stuff like that. Letting your insurance sort it out may be a good idea. Your premium will go up.

    1. He is reversing, you open door, 100% your fault.

    2. You open your door, he reverses into it, 100% his fault.

    Sounds more like scenario 1 that 2.

    Watching someone park and then driving so that they are unable to open their car door would always involve some level of rsponsibility.

    If he was reversing out and scratched the front of his car then the bulk of his car must have been passed your car. Therefore when you opened your door he was already reversing.

    Not correct. The relevant driver was not reversing in a straight line.

    He doesn't seem like he's being very reasonable and went to great lengths to pin blame on you straight away and it's really not all that clear.


    I'd try to get 50/50 and teach the pompous !!! a lesson.

    On what has been posted so far the OP should probably accept no blame - most of what has been said points to the other drivers miscalculation.
