Grant of Confirmation (probate) Property Value

This post relates to Scotland

And apologies if this has been already discussed. My siblings and I are in the process of obtaining a grant of confirmation for my late mother's assets. We have been looking at the DIY route as there is a will and it is relatively simple, a small house worth around 100,000 and a small amount of cash.

The problem I have is that to sell the house we must obtain a Certificate of Confirmation. Initially we were told we just needed a valuation to obtain the documentation. As we are looking to sell offers over the valuation may not be exact. In my opinion we are looking at a few thousands either way not any more. However, now we have been told that if the valuation is not correct we will have to apply for an amendment, which is another £200.

I don't think it is possible to sell without Confirmation and I would be uncomfortable selling the house and then applying if there was some hold up which would inconvenience any potential buyers and we would potentially be in breach of contract.

I would like to file the documentation now using a valuation but I'm confused as to what is the best approach.

Any advice would be much appreciated!

    Told by whom - someone who knows what they're talking about?
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!

    Hi I spoke to someone at the Sheriff's office in Scotland she was very helpful but the information was a bit confusing.

    As I read your first post I was thinking "is this Scotland?" and it's always helpful to state that, because things are different north of the border.

    You can consult a solicitor on this specific point without using them for the whole estate, and that might be helpful. Or you may find you or one of your siblings can access some free legal advice through home insurance or union membership. Make sure it's clear that it's advice about Scottish law you require.

    Also you can write down what you think you've been told and phone again to go through it one more time.
