Thank you.
I couldn't find any example defences from the Newbies thread relating to a PCN for non-payment of parking charge when it had been paid....hence my unsatisfactory defence, but I have no idea what else to write.0 -
Wonder if you would be able to help re. my draft defence re. my recent posts? Would be very grateful.0
-
Did you go to the NEWBIE section post # 2 and scroll down to find this: -
If you cannot find one that fits exactly, use the format to add your defence point in; at least your will have the correct headers and footers. Here are some cases won or in progress:0 -
Thank you - yes I have had a look and there is nothing that fits exactly but I have set out my draft defence correctly as per earlier post. Just its very short! And I didn't know whether to include the details of the DVLA having the wrong address for us hence not receiving any of the PCN correspondence.0

This is my draft defence?
IN THE COUNTY COURT
CLAIM NO.
BETWEEN:
NCP Car Parks Ltd
and
…………….
1. I deny any liability to the Claimant whatsoever on the following basis:
It is stated that the car was parked without payment of the parking charge. This is incorrect as the parking charge was paid for using a debit card in the parking machine.
I believe the facts contained in this Defence Statement are true.
Signed……….

Any chance someone can tell me if this defence is ok and whether to mention at this stage the lack of any correspondence due to the address error?
Many thanks0 -
I have to email this by tonight.0

Read post # 24 again and go off and find the defences that Bargepole wrote and you will see that yours is a "little" short!0
-
as above, if your defence doesnt include ALL of that concise defence by BARGEPOLE , plus a little extra , then its woeful
coupon-mad said this recently
so do it , asapmost people can use bargepole's concise template defence from the NEWBIES thread, and add in a point or two about the facts of the case/contravention/why they are not liable.
And a point about no landowner authority as seen in other defences.0 -
Hi - can anyone help with this? NCP tell me that they have no data for my numberplate - this is what they say -
As there is no data on the PDT machine for (my numberplate) on 13/08/2018, we therefore do not have to disclose any data as none of it is personal data of yours.
I paid for this parking with a debit card but they say they have no record of my numberplate - can i demand that they show me a print out of that days transactions? Maybe I made an error when entering my numberplate.0
