If I have read correctly the right of way will expire in 2085 under all options other than Option 4 which is thought unlikely to meet with Land Reg approval, 66ys time, so an increasing problem with each sale.
You need a ROW granted by Pty No 1 yes? Or do you need to enter land owned by No 3?
Would the indemnity insurance cover you and your successors in title in perpetuity? Is so I think I would be happy with the insurance policy plus something off the price to reflect the deal needed with No 1.0 -
Is it possible for you to negotiate an easement before exchange, but with some kind of guarantee that it will take effect on completion?
But ... is it worth the hassle?0
