Unknown CCJ

I'm trying to release equity on my house but a credit search by the mortgage company shows a CCJ on my file from 1/9/16 which I have no knowledge of. I have never received any paperwork regarding the debt, court date or requests for payment. How do I deal with this please?

    Look at your credit files to find out who it has come from.

    Have you moved house at any point over the past few years?

    This is a good thing. It will allow you to reconsider whether equity release is really a good option for you. In all but a few circumstances, it is not a good choice.

    You can use Trust Online to search for any CCJ's awarded against you. If any are listed you can contact the court for further information.

    Martin spoke about equity release on his latest show, maybe get it on catchup. There's 2 types of equity release.

    If the claim was issued but not served on you in 2016 then you would seeking to make an Application to set aside the Default Judgement (CCJ).

    If you post a little more information I will make suggestions as to how to deal with the situation.

    If the CCJ was for more than £1k then the Judgment Creditor ( i.e the Claimant) has the right to place a Charging Order on your property or a Restriction if the property is in joint names.
