Garage Rental in Wifes name Husband being told he needs to surrender it and rejoin the waiting list?

I have been dealing / helping manage my uncles affairs after his wifes death in December last year.
Most of the bills / accounts were in her name so I have been in the process of getting all these changed to him.
Most have gone smoothly. However, I received a letter from the local housing association requesting a contact after I initialy wrote to inform them of his wifes death and provide a copy of the death certificate. I also requested he assume the tenancy following her death.
After speaking to them today it seems they want the garage back and my uncle will have to re-join the waiting list.
Based on the fact they have both used the garage for many years, this does not seem fair at all. If he had not informed them of his wifes death nothing would have changed.
I have been told I will receive a call in the next couple of days regarding any movement on this policy.
In the meantime I woud welcome any advice from people who have had to deal with a similar issue.

Can you find the rental agreement for the garage? It may not be fair, and it is entirely possible that they wouldn't have known of your aunt's death if you hadn't told them, but what matters is what the signed agreement says.
If you can't find it, ask the HA to send you a copy which you can then go through carefully.Signature removed for peace of mind0 -
You need the agreement. You can't assume he can take over the tenancy if he wasn't the tenant just because he was married to the tenant. It's all based on the terms of the contract and who's nane it was in. It's definitely worth getting a copy of the original in case it was in both of their names.Don't listen to me, I'm no expert!0

And there may be rights to the tenancy of the property after death but not for the garageEx forum ambassador
