Cancelling SCS sofa- help

Back in September we ordered a new sofa and carpet from SCS (specifically being told we will have the sofa by Christmas, in fact it’ll be with us a week after the carpets). Carpets came November 2nd, no problems. Sofa turned up a few days later, only for it to be the wrong one (we did ask them to check before getting it up stairs, but they insisted it’ll be fine).
When the delivery men tried getting it out, they caused damage to our walls and front door, and eventually bashed the feet off using a tool, ruining that sofa (and cutting his hand open).
We have now had months of trying to find out when we will get our new sofa and what is expected to happen about the damage (they initially told us they won’t do anything until we give them three seperate quotes).
Last week we were finally told it’ll come Monday. I waited in. At about 4pm I saw a van drive up around the side of my building and I kept an eye on it assuming people will get out and approach if it was indeed them. However after a few minutes they simply drove off. Turns out they tried calling my partner who was driving at the time and so just left without trying to knock.
We have been so stressed over all this, with the damage and having three kids sitting on the floor over Christmas, that we just want to cancel it and have nothing to do with the company- who have ignored countless emails and phone calls all through the last few months.
We bought it in store on finance and have been making payments (along with our carpet which we have no issues with). They are saying we can’t cancel now, however the contract says we can within two weeks of delivery, so as it hasn’t been delivered why not just cancel it now instead of risking more damage to our home?

    Whichever way you look at this comedy of errors through no fault of yours SCS have a contract that they signed with you at the time of purchase. They appear to have failed miserably and their contract delivery firm has added further to your woes. Under trading law you have to give them the opportunity to remedy their errors, and it seems you have done so. The contract, even the delivery, is with SCS and not the delivery firm and it is SCS who will have to pay for any damage caused to your property.

    Go and see CAB or maybe try and get a free half hour with a solicitor and see exactly where you stand. But don't give up with SCS, be firm and the best thing to do is make sure you have any contact with them on this issue documented. They will try it on if you let them and sadly they have quite a reputation for doing so.
  • Probably easier to pursue it with the finance company. Have you been in touch with them - if not do so. If so, what did they say?
