I am hoping to get some advice please.
I had a ford years back which unfortunately failed MOT due to rust to the underbody.
I sold it for scraps on gumtree sometime between sept 2017.
I forgot to notify my car insurance till late oct 2017 and the policy was subsequently cancelled.
About 3 wks ago, jan 2019, i recieve a call from my olf car insurers , esure, saying the highway agency has contacted them about a damage done to some barrier on the motorway by this ford, sometime in Oct 2017.
I explained i haf sold the car atleast a month prior to the date given and could not have been responsible for any accident.
Today i recieved an unpleasant email saying i owe esure and that a letter has been sent to my address. I then calk and speak with an unpleasant man who says there are major implications for me as the policy was in my name at the time of the accident.
I explaim thr car was sold to a trade company via gumtree and dvla was notified as well at the time.
Esure says i wilm have to pay however they wikl get someone to call me back. Still waiting for the call back
In the meantime can anyone pls shed some light on this please.

Can you prove you sold it when you said you did?0
-
Yes i can. Whilst i have lost the dvla letter that initially came, i have requested anothet one by filling a V88 form.
Infact, i remember that it was on receipt of the DVLA letter back in 2017 that prompted me to cancel the insurance0

Then that should get you off the hook. If you can prove you disposed of the vehicle, particularly if you have the DVLA documents to confirm it, Esure should stop pursuing you.0

If your car insurance policy was the only policy active on the vehicle at the time of the accident then your car insurance company may pay out, mark it as a claim on the central database they all use then pursue you for the money. All your base are belong to us.0

Proof of disposal won't help.Keepingmum wrote: »Yes i can. Whilst i have lost the dvla letter that initially came, i have requested anothet one by filling a V88 form.

You need proof of cancellation of the insurance prior to the incident you are now being asked to pay for0

If i can track the trade company that purchased the car, whom i ll like to imagine woukd have insurance, will i still be liable for the payment?0

Then I stand corrected. I would have thought with no insurable interest at the time of the accident, the previous owner would not be liable. Why is that not the case?0

 The RTA covers this.
The insurer is liable if the policy is in force, but can pursue the policyholder if they neglected to notify the disposal
All covered by wording in the policy, and why you should always notify your insurer immediately a vehicle is disposed of.0
